Discharge of contract, damages, exemption clauses and capacity to contract are tested through scenario-based problem questions and essay-style questions in this Law topic, drawn from 59 real questions set in 2023 to 2025 papers.
Discuss, assess and to what extent govern the 25-mark essays, which need full case citation and balanced argument on both sides of a debate, while scenario questions reward methodically applying named rules such as the Consumer Rights Act 2015 to each party in turn. Because citation quality is repeatedly flagged as the difference between AO1-only and higher-level answers, drafting a full response and marking it instantly is the fastest way to check whether every legal point carries a supporting case or statute.
What examiners look for
- A recurring criticism is responses that achieve marks for AO1 only, with citation often lacking or incomplete, and remoteness covered well while causation and mitigation are addressed only individually rather than together.
- Examiners repeatedly note responses that misidentify the focus of a discharge question, writing instead about frustration or common law remedies, which receives no credit.
- Reports flag conclusions that reach the correct outcome without basing that conclusion on law.
- Strong answers explain the rule in Pinnel's Case and promissory estoppel together, analysing how far the equitable principle has mitigated the injustice of the common law position.
- Strong responses cite the opera singer cases and Hong Kong Fir with detailed, supported arguments on the tension between certainty and flexibility in the law of terms.
